Privacy
HCi is committed to the principles and practice of privacy, as set out in the Privacy Act. This statement sets out the detail that backs up that commitment.
HCi is bound by the Privacy Act 1988, as amended by the Privacy Amendment (Enhancing Privacy Protection) Act 2012.
Candidates
The information that we hold on candidates for employment includes:
- contact details
- resumes
- attributes self-reported by candidates (years of experience, qualifications, etc)
- other employment records (timesheets, tax details and so on)
The purpose for holding this information is to allow us to assess the suitability of a candidate for employment by HCi, or by an HCi client; to contact candidates on a regular basis to keep their records up to date; to contact candidates to let them know that work is available for them.
We do not provide any of this information to anyone, except with the express consent of the candidate. For example, we do not provide a copy of a resume, or reference checks, or any other material to any client without first asking the candidate whether we can pass their details to that client. Where the client is overseas, we treat approval to send the information to that client overseas implicit in the approval by the candidate to send the information to the client. We withhold address and other unnecessary candidate details from clients.
In order to access or change any personal information, please simply contact us. When we are sure of your identity, we will gladly provide access to any of the data shown above.
We also hold the following information, to which we cannot provide open access to candidates, because it would reveal commercially-sensitive areas of our business:
- results from our internal exams and tests
- attributes reported by HCi staff
- our impressions of the candidate at interview
If you feel that you would like to access or change these, we will be happy to do so through an independent third party. However, please note that we will charge for this work at our current consulting rate.
We also hold the following information, to which we cannot give access because it would infringe the privacy of others:
- records of reference checks and other references
And finally we cannot give access to the following, because it would compromise our ability to negotiate in future:
- notes of our negotiations with the candidate
Clients
The information we hold on individuals working in client and potential client organisations includes:
- contact details
If you would like to check or amend your contact details, please contact us.
We also hold:
- records of our commercial sales process with the client
- records of our commercial negotiations with the client
Unfortunately, we cannot provide access to this information due to its commercial sensitivity.
Referees
We contact ex-employers of candidates for references, and record their impressions of the candidates, along with the referee’s name, job title and employer.
We provide this information on request to clients who are considering employing the candidate.
We do not provide access to this information to the candidate who the opinion is about.
If as a referee you would like to check or amend your reference for a candidate, please contact us.
Sensitive information
We do not collect sensitive information about candidates, such as their gender, sexual preferences, race, religion, political affiliation, etc.
Cross-border disclosure
All of the information that we store is kept in a cloud-based computer system which may in practice be physically located anywhere on Earth. However, we take reasonable steps through our agreement with our cloud service provider and our normal security precautions on passwords and so on to ensure that none of the information is accessible from overseas.
Direct marketing
We use contact details for both clients and candidates for our own direct marketing, including email, telephone marketing and paper mail marketing. We do not use any contractors for this work.
If you at any time receive any communication from HCi which you would not like to receive, please contact us and we will remove your name from our mailing list.
We may from time to time provide lists of names and contact details to associated companies and subsidiaries which operate in a closely related field, and which comply with the same privacy principles as HCi.
Clickstreams
Our service provider makes a record of your visit and logs the following information for statistical purposes – the user’s server address, the user’s top level domain name (eg. .com, .gov, .au, .uk etc.), the date and time of the visit to the site, the pages accessed and documents downloaded, the previous site visited and the type of browser used. No attempt will be made to identify users or their browsing activities except, in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the service provider’s logs.
We use third-party advertising companies to serve ads when you visit our website. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.
We will only record your e-mail address if you send us a message.
Terms of Trade
The following are our terms of business. If you do business with us, then the following terms will be construed as being part of our agreement unless explicitly set aside or varied by a written agreement signed by us.
HCi Professional Services (“HCi”) has been asked by you to provide resume and other information (“Details”) of one or more people (“HCi Experts”) to carry out work for you. In reading these Details, you indicate your agreement to be bound by the terms set out in this document.
You agree to hire HCi Experts only by entering into a written contract with HCi signed by both parties. If you hire any HCi Expert, either directly or via one or more intermediary entities, within 12 months of HCi providing Details of that Expert to you, and without a written agreement covering that hire from HCi, then you agree to pay HCi a placement fee of 30% of the annual salary of the Expert. This amount is due and payable as soon as you hire the HCi Expert.
